Este modelo de proyecto de ley para la prohibición de inyecciones basadas en ADN/ARN es un marco legislativo diseñado para servir como herramienta para los legisladores y ciudadanos que buscan prohibir el uso, la venta y la distribución de inyecciones basadas en ADN/ARN en humanos, animales y productos agrícolas dentro de su jurisdicción.
Este modelo proporciona una base integral para que los legisladores elaboren un proyecto de ley que se ajuste a las necesidades específicas de su estado o mporvincia y, al mismo tiempo, mantengan una postura firme contra las tecnologías de inyecciones basadas en genes, incluidas las inyecciones de ARNm, ARNm modificado, ARNsa y ADN.
Los legisladores pueden personalizar el título del proyecto de ley como lo consideren conveniente, pero el objetivo principal sigue siendo el mismo: salvaguardar la salud pública, la seguridad alimentaria y la soberanía estatal al prevenir la modificación genética en aplicaciones médicas y agrícolas.
Este modelo de proyecto de ley se distingue por su rigor científico y legal, y proporciona a los legisladores un marco completamente desarrollado y respaldado por una amplia investigación revisada por pares y datos fidedignos.
Cada declaración de «Considerando» del proyecto de ley está respaldada meticulosamente por citas de revistas médicas de alto impacto, informes gubernamentales y análisis de expertos, lo que garantiza que los legisladores tengan la base más sólida posible para sus esfuerzos legislativos.
No solo describe la política en sí, sino que también proporciona a los legisladores la evidencia científica y la justificación legal necesarias para defender y hacer cumplir la prohibición de las vacunas basadas en ADN/ARN.
Al consolidar estas fuentes en un formato estructurado, el proyecto de ley permite a los legisladores redactar una legislación que sea sólida en cuanto a los hechos, legalmente defendible y resistente al rechazo de la industria o de las autoridades regulatorias.
A diferencia de las regulaciones federales que pueden permitir estas vacunas bajo disposiciones de uso de emergencia o directrices de agencias en evolución, este modelo de proyecto de ley afirma la autoridad estatal o porvincial para hacer cumplir una prohibición total, incluso durante crisis de salud declaradas.
Define las inyecciones basadas en ADN/ARN de manera amplia, asegurando que cualquier producto que modifique, transfiera o utilice material genético para inducir una respuesta inmune esté sujeto a la prohibición, incluidos los productos de terapia génica humana y los microorganismos modificados genéticamente.
Además, el proyecto de ley faculta a los fiscales generales y a las agencias de aplicación de la ley para investigar y enjuiciar las violaciones, al tiempo que otorga a las personas afectadas el derecho a emprender acciones legales privadas.
También se incluyen protecciones para los denunciantes e incentivos financieros para denunciar actividades ilegales con el fin de fortalecer la aplicación de la ley.
Al adoptar este marco legislativo, los estados pueden hacer valer su autoridad para regular las intervenciones farmacéuticas y agrícolas, garantizando la transparencia, el consentimiento informado y la protección de los ciudadanos, los animales y las fuentes de alimentos frente a tecnologías genéticas no probadas o peligrosas.
Título y Propósito
Esta Ley se conocerá como la “Ley de Seguridad y Soberanía de las Vacunas Basadas en ADN/ARN de [SU ESTADO o PROVINCIA]”. Su propósito es proteger la salud, seguridad y autonomía de [SU ESTADO o PROVINCIA] prohibiendo el uso, venta y distribución de inyecciones basadas en ADN/ARN en humanos, animales y productos agrícolas dentro del estado, incluso durante emergencias declaradas.
Intención y Justificación Legislativa
Al reconocer los riesgos significativos asociados con estas tecnologías (incluidos los efectos adversos para la salud, la falta de datos de seguridad a largo plazo y los posibles impactos ambientales), esta legislación garantiza protecciones sólidas independientemente de las circunstancias que de otro modo podrían permitir atajos regulatorios o una menor supervisión durante emergencias de salud pública.
Al abordar estas preocupaciones y defender los principios de consentimiento informado, transparencia e integridad científica, esta Ley afirma el compromiso de [SU ESTADO o PROVINCIA] de proteger a sus ciudadanos, animales y sistemas agrícolas de intervenciones farmacéuticas no probadas o potencialmente peligrosas.
Definición de vacunas basadas en ADN/ARN
A los efectos de este proyecto de ley, las “vacunas basadas en ADN/ARN” se refieren a todos los productos que pretenden funcionar mediante la utilización, modificación o transferencia de material genético para inducir una respuesta inmunitaria. Esto incluye las vacunas basadas en genes desarrolladas mediante tecnología de ácido ribonucleico mensajero (ARNm), tecnología de ácido ribonucleico mensajero modificado (ARNmod), tecnología de ácido ribonucleico mensajero autoamplificado (ARNsa) o tecnología de ácido desoxirribonucleico (ADN).
Además, la definición abarca los productos de terapia génica humana que median sus efectos mediante la transcripción o traducción de material genético transferido o alterando específicamente secuencias genéticas humanas. Estos productos incluyen ácidos nucleicos como plásmidos y ácido ribonucleico (ARN) transcrito in vitro; microorganismos modificados genéticamente, como virus, bacterias y hongos; nucleasas específicas de sitio diseñadas para la edición del genoma humano; y células humanas modificadas genéticamente ex vivo.
Al definir las vacunas basadas en ADN/ARN de esta manera, el proyecto de ley garantiza que todas las formas de inmunización basadas en material genético y enfoques de terapia génica, incluidas tanto las inyecciones directas de material genético como el uso de portadores modificados genéticamente, estén bajo su jurisdicción.
Aplicación y sanciones
Cualquier persona, entidad, corporación, agencia gubernamental u organización que fabrique, distribuya, administre o facilite la venta de inyecciones , (mal llamadas vacunas) basadas en ADN/ARN en violación de esta Ley estará sujeta a sanciones civiles y penales.
Se impondrá una multa de no menos de $xxxxxxx por infracción por cada caso de producción, venta o administración no autorizada de vacunas basadas en ADN/ARN dentro del estado, y cada acto de distribución o administración a un individuo, animal o producto agrícola por separado constituirá una infracción separada.
Además, cualquier persona o entidad que viole consciente y deliberadamente esta Ley será culpable de un delito grave punible con una multa de hasta $xxxxxxx y/o prisión por un período que no exceda los xx años.
Autoridad legal y mecanismos de cumplimiento
El Fiscal General de [SU ESTADO o PROVINCIA] y cualquier agencia de cumplimiento de la ley debidamente designada tendrán la autoridad de investigar y procesar las violaciones, iniciar acciones civiles para prohibir la continuación de las infracciones y buscar la restitución para las personas, empresas o entidades agrícolas afectadas.
Derecho de acción privado
Además, cualquier residente de [SU ESTADO o PROVINCIA] que esté sujeto a la administración de inyecciones basadas en ADN/ARN en violación de esta Ley puede iniciar una causa de acción privada contra las partes responsables para buscar daños compensatorios y punitivos, incluidos los honorarios de los abogados y las costas judiciales.
Protección e incentivos para los denunciantes
Los denunciantes que denuncien infracciones estarán protegidos contra represalias y podrán ser elegibles para una recompensa de hasta el 30 % de las multas cobradas si su información conduce a una acción de cumplimiento exitosa.

Considerando que hay evidencia sustancial que revela que las inyecciones basadas en ADN/ARN son ineficaces para prevenir la infección, la transmisión, la enfermedad grave, la hospitalización o la muerte, y que existe preocupación adicional por la rápida disminución de la inmunidad y los mayores riesgos asociados con su uso.
